Make It Count

1) Agreement

By subscribing to or using Make it Count (the “Service”), you agree to these Terms.

2) The Service

The Service sends scheduled emails based on your preferences (selected days, one delivery time, and timezone). You can update your preferences using the settings link provided in emails.

3) Email delivery and availability

The Service is provided on a best-effort basis. Delivery times may vary due to email provider delays, spam filtering, outages, or network issues. We do not guarantee uninterrupted availability or exact delivery times.

4) Sponsored messages

Emails may include a short sponsored message. Sponsors do not receive your email address. Sponsored content is provided “as is” and does not constitute an endorsement.

5) Unsubscribe = delete account

Every email includes an Unsubscribe link.

Clicking Unsubscribe permanently deletes your account immediately and stops all future emails.

To use the Service again, you will need to subscribe again.

6) Acceptable use

You agree not to misuse the Service, attempt unauthorized access, disrupt operations, or use the Service for unlawful purposes.

7) Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind. The Service is not professional advice.

8) Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

Where liability cannot be fully excluded, our total liability for any claim related to the Service will be limited to CHF 50.

9) Changes

We may update the Service or these Terms from time to time. We will update the effective date when we do.

10) Governing law and venue

These Terms are governed by the laws of Switzerland. Any disputes will be subject to the exclusive jurisdiction of the courts in Fribourg, Switzerland.

11) Data we collect

We collect only what is needed to provide the Service:

• Email address
• Timezone
• Schedule preferences (days of week, delivery time)
• Service events (sent, bounced, unsubscribed/account deleted)

We may also maintain anonymized technical logs for security and reliability. These logs do not contain personal data.

12) Email tracking (opens and clicks)

We use email tracking to understand deliverability and engagement:

• Open tracking (for example, via a small tracking pixel when images are loaded)
• Click tracking (when you click tracked links)

Tracking data may include timestamps and technical information (depending on your email client and settings). You can reduce open tracking by blocking images in your email client.

13) How we use your data

We use personal data to:

• Send scheduled emails and operate your settings
• Verify email ownership (confirmation link)
• Monitor deliverability and prevent abuse
• Improve the Service using aggregated analytics
• Comply with legal obligations and enforce these Terms

14) Sponsors and sharing

We do not sell your email address. We do not share your email address with sponsors. Sponsors may receive aggregated statistics (for example, total sends or total clicks), not personal identifiers.

15) Processors (service providers)

We use the following providers to operate the Service:

• Postmark (email delivery, bounce handling, unsubscribe handling, open/click tracking)
• Render (application hosting and infrastructure, including database hosting if applicable)

These providers may process data in different regions. Where required, we use appropriate safeguards for international data transfers.

16) Deletion and retention

When you click Unsubscribe, your account is deleted immediately and your personal data is removed immediately from our active systems.

We may retain anonymized logs for security, reliability, and debugging. These logs do not contain personal data.

17) Your rights

Depending on your location, you may request access, correction, deletion, restriction/objection, or a copy of your data, and withdraw consent where applicable. Contact us at contact@laurieherault.com.

18) Security

We use reasonable security measures (access controls, encrypted connections, monitoring). No system is perfectly secure.

19) Children

The Service is not intended for children under 16 (or the minimum age required where you live).

20) Changes

We may update this Privacy Policy from time to time. We will update the effective date when we do.
